These Terms & Conditions ("Terms", "Agreement") govern the access to and use of Kaamvali.com and the placement, recruitment, coordination, replacement and related domestic help services provided by Kaamvali.com ("Kaamvali", "we", "us", "our") to any person availing such services ("Client", "you", "your").

By registering with Kaamvali.com, making any payment, requesting a domestic worker, accepting a candidate, permitting a candidate to commence services, or otherwise using our services, you acknowledge that you have read, understood and agreed to be legally bound by these Terms.

If you do not agree to these Terms, you must not use or continue to use the Services.


1. DEFINITIONS

For the purposes of these Terms:

1.1 "Agency" / "Kaamvali"

Means Kaamvali.com and its authorised representatives, employees, coordinators, field staff, agents and personnel engaged in providing placement and related services.

1.2 "Client"

Means any individual, family, household, organisation or other person who requests, purchases or avails domestic help placement or related services from Kaamvali.

1.3 "Domestic Worker" / "Maid"

Means any domestic worker, including but not limited to housemaids, live-in maids, cooks, babysitters, elderly-care workers, cleaners or other domestic personnel introduced, referred, coordinated or placed through Kaamvali.

1.4 "Placement"

Means the introduction and/or deployment of a Domestic Worker to the Client pursuant to a service request accepted by Kaamvali.

1.5 "Service Commencement"

Means the date on which the Domestic Worker physically joins or commences domestic services at the Client's premises, whether on a trial, temporary, probationary or continuing basis.

1.6 "Agency Fee"

Means the fee payable by the Client to Kaamvali for placement, recruitment, coordination, verification, onboarding, operational support and related agency services, as applicable.

1.7 "Replacement"

Means the introduction of another reasonably suitable Domestic Worker by Kaamvali following discontinuation of the initially placed Domestic Worker, subject to these Terms and availability.

2. NATURE AND SCOPE OF SERVICES

2.1 Kaamvali provides domestic-worker placement, recruitment, coordination and related support services.

2.2 Kaamvali shall use commercially reasonable efforts to identify and introduce Domestic Workers based upon the Client's stated requirements, including, where applicable, duties, location, salary range, working arrangement, experience and duration.

2.3 Kaamvali does not guarantee that a particular individual will remain employed for any specified period, as Domestic Workers are independent persons whose personal circumstances, availability, conduct and decisions may change.

2.4 The availability of Domestic Workers is subject to prevailing market conditions, candidate availability, salary expectations, location, nature of duties and other relevant factors.

2.5 Kaamvali reserves the right to determine whether a proposed candidate is reasonably suitable based upon the requirements communicated by the Client.

3. CLIENT INFORMATION AND COOPERATION

3.1 The Client shall provide complete, accurate and current information concerning:

3.2 The Client shall not materially alter the agreed requirements after placement without informing Kaamvali.

3.3 Any material change in duties, working hours, salary, location, accommodation, household requirements or other placement conditions may affect candidate availability, replacement timelines and the applicability of any refund.

3.4 Any delay, refusal or failure by the Client to cooperate, provide information, attend interviews, accept reasonable candidate options, facilitate joining or otherwise cooperate with Kaamvali may extend service timelines and may affect the Client's eligibility for refund.

4. PLACEMENT AND CANDIDATE ACCEPTANCE

4.1 Kaamvali may introduce one or more candidates based upon the Client's stated requirements.

4.2 The Client shall independently satisfy itself regarding the suitability of any Domestic Worker before permitting commencement of services.

4.3 Acceptance of a candidate by the Client shall constitute confirmation that the candidate has been accepted for the applicable placement arrangement.

4.4 The Client's personal preference, subsequent change of mind, change in household circumstances, change in budget or refusal to accept a reasonably suitable candidate shall not, by itself, constitute failure of service by Kaamvali.

5. SERVICE COMMENCEMENT AND OPERATIONAL COSTS

5.1 Service shall be deemed to have commenced once the Domestic Worker joins or begins providing services at the Client's premises.

5.2 Upon Service Commencement, Kaamvali shall be deemed to have incurred operational, coordination, onboarding, field-staff, administrative and other costs associated with the placement.

5.3 Accordingly, where a refund is otherwise permissible after Service Commencement, a fixed amount of ₹5,000 (Rupees Five Thousand only) shall be deducted towards operational, onboarding, coordination, staff deployment and administrative costs.

5.4 The aforesaid deduction shall apply irrespective of whether the Domestic Worker worked for one day or for a longer period, subject to the specific refund provisions contained herein.

6. AGENCY FEE STRUCTURE

The Agency Fee shall be calculated with reference to the Domestic Worker's agreed monthly salary and shall be determined according to the intended placement period as follows:

Up to and including 3 months 50% of one month's agreed salary
More than 3 months and up to 6 months 70% of one month's agreed salary
More than 6 months and up to 11 months 100% of one month's agreed salary

6.1 Minimum Placement Period: For Agency Fee purposes, the minimum applicable placement period shall be deemed to be 3 months, even where the Client intends to retain the Domestic Worker for a shorter period.

6.2 Accordingly, where a Domestic Worker is engaged for only one month or any period below three months, the applicable Agency Fee shall nevertheless be calculated at the minimum 3-month slab.

6.3 Unless expressly stated otherwise in writing, the Agency Fee is separate from the Domestic Worker's salary.

6.4 The Client shall pay the Domestic Worker's salary directly in accordance with the agreed employment arrangement, unless an alternative arrangement has been expressly agreed in writing.

6.5 Applicable taxes, government charges or transaction charges, where legally applicable, may be charged separately.

7. PAYMENT OBLIGATIONS AND DEFAULT

7.1 All amounts payable to Kaamvali shall be paid on or before the applicable due date.

7.2 Any amount remaining unpaid after its due date shall constitute a payment default.

7.3 In the event of delayed payment, Kaamvali shall be entitled to levy interest at the rate of 1.5% per month (18% per annum) on the outstanding amount from the date of default until the date of actual payment, subject to applicable law.

7.4 Kaamvali reserves the right to suspend services, replacement assistance, coordination or other benefits until all overdue amounts have been paid.

7.5 Continued non-payment may constitute a material breach of these Terms and may result in termination of the Client's service arrangement.

8. 90-DAY PLACEMENT COMMITMENT AND REFUND ELIGIBILITY

8.1 Kaamvali shall use commercially reasonable efforts to identify and provide a reasonably suitable Domestic Worker within 90 calendar days from the date of successful payment and registration, subject to the Client's cooperation and availability for suitable candidates.

8.2 If Kaamvali is unable to provide any reasonably suitable Domestic Worker within the aforesaid 90-day period, the Client may become eligible to initiate a refund request in accordance with this Policy.

8.3 The 90-day period shall not be treated as a guarantee of acceptance by the Client of any particular candidate.

8.4 The Client shall not be entitled to a refund merely because the Client rejects a candidate on the basis of personal preference, change of requirements, salary expectations, appearance, language preference, household preference or other subjective grounds, where the candidate was reasonably consistent with the requirements communicated to Kaamvali.

8.5 The 90-day period may be extended to the extent that service delivery is delayed due to the Client's failure to cooperate, failure to provide required information, refusal to consider reasonably suitable candidates, change in requirements, unavailability of the Client, or any circumstance beyond Kaamvali's reasonable control.

9. CANCELLATION AND REFUND POLICY

9.1 Refund Before Service Commencement

A Client may request cancellation before Service Commencement.

However, cancellation shall not automatically create a right to refund. Eligibility shall be determined in accordance with the terms of this Policy and the stage at which Kaamvali's services have progressed.

9.2 Refund Due to Non-Placement Within 90 Days

Where:

  1. the Client has complied with all obligations under these Terms; and
  2. Kaamvali has failed to provide a reasonably suitable Domestic Worker within 90 calendar days; and
  3. the failure is not attributable to the Client's refusal, delay, changed requirements or lack of cooperation,

the Client may submit a written refund request. Any approved refund shall be processed in accordance with Kaamvali's internal refund procedure.

9.3 Cancellation After Service Commencement

Once Service Commencement has occurred, any refund otherwise found to be payable shall be subject to deduction of ₹5,000 towards operational, onboarding, coordination, field-staff deployment and administrative costs.

9.4 No Automatic Refund for Client Preference

No refund shall be automatically payable merely because:

Where a refund is approved, Kaamvali may process the refund to the original payment method or another payment method reasonably designated by Kaamvali. Applicable transaction charges, third-party charges and other non-recoverable costs may be deducted where legally permissible.

10. REPLACEMENT POLICY

10.1 Subject to the applicable service arrangement, Kaamvali may provide replacement assistance where the initially placed Domestic Worker discontinues services.

10.2 Replacement shall be subject to candidate availability and prevailing market conditions.

10.3 The salary applicable to a replacement Domestic Worker shall be determined based on the prevailing market rate, candidate experience, duties, location, working hours, live-in requirements and other relevant factors at the time of replacement.

10.4 The Client acknowledges that the salary applicable to a replacement may be higher or otherwise different from that of the previous Domestic Worker.

10.5 Kaamvali shall not be obligated to provide a replacement at the salary previously paid if such salary is no longer commercially reasonable or consistent with prevailing market conditions.

10.6 If the Client refuses a reasonably suitable replacement solely because the prevailing market salary is higher, or for reasons unrelated to a material service deficiency by Kaamvali, such refusal shall not automatically create a right to refund.

10.7 Replacement availability is subject to market conditions and does not constitute an unconditional guarantee of immediate placement.

11. CLIENT RESPONSIBILITIES TOWARDS DOMESTIC WORKERS

The Client shall provide a safe, respectful and lawful working environment and shall comply with the following obligations:

11.1 The Client shall pay the agreed monthly salary to the Domestic Worker in full and on time.

11.2 The Domestic Worker shall be provided with the agreed weekly/monthly rest and leave arrangement. Unless otherwise agreed in writing, the Client shall provide at least two days of leave/rest per month.

11.3 For live-in Domestic Workers, the Client shall provide suitable, safe, clean and hygienic accommodation.

11.4 The Client shall provide adequate and reasonably suitable food arrangements where food is included within the agreed live-in arrangement.

11.5 The Client shall provide reasonable daily rest and sleeping time and shall not require continuous or excessive work beyond the agreed working arrangement.

11.6 The Client shall not subject any Domestic Worker to physical abuse, verbal abuse, threats, intimidation, harassment, humiliation, discrimination or degrading treatment.

11.7 The Client shall not unlawfully withhold salary, personal belongings, identity documents or other property belonging to the Domestic Worker.

11.8 The Client shall not compel a Domestic Worker to perform any act against her will or in violation of applicable law.

12. SCOPE OF WORK AND PROHIBITION ON UNAUTHORISED DUTIES

12.1 The Domestic Worker shall be required to perform only those duties mutually agreed upon and recorded in the applicable placement/service arrangement.

12.2 The Client shall not compel or require the Domestic Worker to undertake materially different, additional, hazardous or unrelated duties without prior communication with Kaamvali and, where applicable, agreement on revised terms.

12.3 Where the Client requires additional services or materially changes the nature of work, the Client must notify Kaamvali before requiring such work.

12.4 The Client shall not use threats, coercion, force or intimidation to compel a Domestic Worker to undertake duties outside the agreed scope.

12.5 Any dispute concerning additional work shall be referred to Kaamvali for coordination and resolution.

13. PROHIBITION AGAINST ABUSE, HARASSMENT AND MISCONDUCT

13.1 Any act of physical violence, sexual harassment, intimidation, threats, abusive language, humiliation, coercion, discrimination or other serious misconduct towards a Domestic Worker or Kaamvali personnel shall constitute a material violation of these Terms.

13.2 Kaamvali reserves the right, where reasonably necessary, to suspend or terminate services where the Client's conduct creates an unsafe, abusive or otherwise unacceptable environment.

13.3 The Client shall not retaliate against any Domestic Worker for raising a complaint or reporting misconduct.

13.4 Any serious incident shall be reported to Kaamvali immediately so that appropriate action may be considered.

14. DIRECT DEALING, BYPASSING AND CIRCUMVENTION

14.1 The Client shall not circumvent or attempt to circumvent Kaamvali in relation to a Domestic Worker introduced, referred or placed through Kaamvali.

14.2 Without prior written consent from Kaamvali, the Client shall not:

14.3 Ordinary day-to-day communication between the Client and Domestic Worker concerning household duties shall not, by itself, constitute circumvention.

14.4 Any deliberate attempt to bypass Kaamvali may constitute a material breach and may result in suspension or termination of the Client's service arrangement and any other remedies available to Kaamvali under applicable law.

15. REPORTING OF INCIDENTS, COMPLAINTS AND ALLEGATIONS

15.1 The Client shall promptly notify Kaamvali of any material incident involving a Domestic Worker, including suspected theft, misconduct, violence, disappearance, serious damage, unauthorised absence, threats, disputes or other serious concerns.

15.2 The Client should, wherever reasonably available, provide supporting evidence including messages, photographs, recordings, CCTV footage, documents, payment records or other relevant factual material.

15.3 Kaamvali may request additional information from the Client and/or Domestic Worker for the purpose of reviewing and resolving the complaint.

15.4 Kaamvali may conduct an internal review and coordinate with the relevant parties before determining an appropriate course of action.

15.5 Kaamvali shall not be deemed to have accepted or admitted any allegation merely by receiving or investigating a complaint.

15.6 Where the Client fails to promptly report a material incident, Kaamvali may be unable to properly investigate, intervene or provide assistance in relation thereto.

15.7 To the extent permitted by applicable law, Kaamvali shall not be responsible for consequences materially arising from the Client's failure to promptly report a serious incident or provide relevant information.

16. DUTY TO INFORM KAAMVALI OF MISCONDUCT

16.1 The Client shall not knowingly conceal, suppress or withhold material information concerning serious misconduct by a Domestic Worker.

16.2 If the Client becomes aware of theft, violence, threats, abuse, serious negligence, disappearance or other material misconduct, the Client shall inform Kaamvali without undue delay.

16.3 Timely reporting enables Kaamvali to investigate, coordinate, document and, where appropriate, provide assistance to the Client.

16.4 Failure to report a material issue in a timely manner may materially restrict Kaamvali's ability to assist the Client and may affect any claim against Kaamvali relating to such incident.

17. KAAMVALI STAFF AND REPRESENTATIVES

17.1 The Client shall communicate with Kaamvali employees, field staff, coordinators and representatives in a respectful and professional manner.

17.2 Threatening, abusive, insulting, discriminatory or intimidating conduct towards Kaamvali personnel shall constitute a violation of these Terms.

17.3 Kaamvali reserves the right to suspend communication, field visits, replacement assistance or other services where continued interaction presents a reasonable risk to its personnel.

18. CLIENT'S RESPONSIBILITY FOR WORKING CONDITIONS

18.1 The Client acknowledges that a Domestic Worker is entitled to reasonable dignity, safety, rest and fair treatment.

18.2 The Client shall maintain premises in a reasonably safe, hygienic and suitable condition for the Domestic Worker.

18.3 In the case of live-in employment, the Client shall provide suitable sleeping accommodation and reasonable access to food, sanitation and personal hygiene facilities.

18.4 The Client shall not impose working conditions materially inconsistent with the agreed placement terms without prior communication with Kaamvali.

19. INDEPENDENT CONDUCT OF DOMESTIC WORKERS

19.1 Kaamvali does not control the personal conduct, decisions, movements or actions of a Domestic Worker outside the scope of the agreed placement.

19.2 Kaamvali shall, however, reasonably assist in coordinating reported placement-related concerns brought to its attention in a timely manner.

19.3 Kaamvali shall not be responsible for acts or omissions of a Domestic Worker that occur outside the scope of Kaamvali's services, except to the extent liability cannot lawfully be excluded.

20. VERIFICATION AND INFORMATION

20.1 Where verification or documentation is part of the service, Kaamvali may collect and review information provided by or relating to a Domestic Worker.

20.2 The Client acknowledges that verification processes may depend upon the availability, authenticity and accuracy of information supplied by third parties or the Domestic Worker.

20.3 No verification process shall be interpreted as an absolute guarantee against future misconduct, misrepresentation, negligence, disappearance or other conduct by a Domestic Worker.

20.4 The Client remains responsible for exercising reasonable care and supervision within its premises.

21. TERMINATION BY KAAMVALI

Kaamvali may suspend or terminate a Client's service arrangement where:

  1. the Client materially breaches these Terms;
  2. the Client fails to make required payments;
  3. the Client engages in abusive, threatening or unlawful conduct;
  4. the Client attempts to circumvent Kaamvali;
  5. the Client creates an unsafe or hostile environment for a Domestic Worker or Kaamvali personnel;
  6. the Client provides materially false or misleading information; or
  7. continued provision of services is reasonably considered impracticable, unsafe or contrary to applicable law.

Where termination results from the Client's material breach, the Client shall not automatically be entitled to a refund.

22. FORCE MAJEURE

Kaamvali shall not be liable for delay or inability to perform its obligations where such delay or inability arises from circumstances beyond its reasonable control, including but not limited to natural disasters, epidemics, government restrictions, civil disturbances, transportation disruptions, labour disruptions, technological failures, communication failures, candidate shortages or other unforeseen circumstances.

23. LIMITATION OF LIABILITY

23.1 To the maximum extent permitted by applicable law, Kaamvali shall not be liable for indirect, incidental, consequential, special or exemplary loss arising from the acts or omissions of a Domestic Worker.

23.2 Nothing contained herein shall exclude or limit liability that cannot lawfully be excluded or limited under applicable law.

23.3 To the maximum extent permitted by applicable law, Kaamvali's aggregate liability arising out of a particular placement shall not exceed the Agency Fee actually paid by the Client for that placement.

24. INDEMNIFICATION

The Client agrees to indemnify and hold harmless Kaamvali, its employees, representatives, agents and personnel against claims, losses, liabilities, costs and expenses arising from:

  1. the Client's breach of these Terms;
  2. unlawful or abusive conduct by the Client or persons under the Client's control;
  3. false, inaccurate or misleading information supplied by the Client;
  4. unauthorised duties imposed upon a Domestic Worker;
  5. failure to comply with applicable laws or contractual obligations; or
  6. any direct arrangement entered into by the Client with a Domestic Worker in violation of these Terms,

except to the extent caused by Kaamvali's own proven negligence or wilful misconduct.

25. COMPLAINTS AND GRIEVANCE PROCEDURE

25.1 Any complaint concerning a Domestic Worker, Kaamvali personnel, placement or service should be communicated to Kaamvali promptly.

25.2 The complaint should contain sufficient factual information to enable Kaamvali to review the matter.

25.3 Kaamvali may request supporting documents, messages, photographs, recordings or other evidence where reasonably necessary.

25.4 Kaamvali shall review complaints in good faith and may, depending upon the circumstances, coordinate a resolution, recommend corrective measures, arrange replacement or take other appropriate action.

25.5 Submission of a complaint does not automatically establish liability on the part of Kaamvali or the Domestic Worker.

26. REFUND REQUEST PROCEDURE

Any Client seeking a refund must submit a written request through the official communication channel designated by Kaamvali.

The request should include:

Kaamvali may request additional information before determining eligibility.

An approved refund shall be processed within a reasonable period after approval, subject to payment-gateway, banking and other processing timelines.

27. NO WAIVER

Failure or delay by Kaamvali in enforcing any provision of these Terms shall not constitute a waiver of its right to enforce that provision or any other provision at a later date.

28. SEVERABILITY

If any provision of these Terms is held to be invalid, unlawful or unenforceable by a competent authority, such provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

29. AMENDMENTS

Kaamvali reserves the right to modify, amend or update these Terms from time to time.

The revised Terms shall become effective upon publication on the Website or upon communication to the Client, as applicable.

Continued use of the Services following such amendment shall constitute acceptance of the revised Terms, to the extent permitted by applicable law.

30. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of India.

31. DISPUTE RESOLUTION

31.1 The parties shall initially attempt to resolve any dispute, complaint or disagreement amicably through good-faith communication.

31.2 Where the dispute cannot be resolved amicably, either party may pursue such remedies as may be available under applicable law.

31.3 Subject to applicable law, the courts having competent jurisdiction over Mumbai, Maharashtra shall have jurisdiction over disputes arising out of or relating to these Terms.

32. ENTIRE AGREEMENT

These Terms, together with any applicable placement form, service confirmation, quotation, invoice or written agreement issued by Kaamvali, constitute the entire agreement between the Client and Kaamvali concerning the relevant Services and supersede prior oral or written communications relating to the same subject matter, except where expressly agreed otherwise in writing.

33. CLIENT ACKNOWLEDGEMENT

By making payment, confirming a placement, accepting a Domestic Worker, allowing Service Commencement or continuing to use Kaamvali's Services, the Client confirms that:

  1. the Client has read and understood these Terms;
  2. the Client agrees to comply with all applicable obligations;
  3. the Client understands the Agency Fee structure;
  4. the Client understands the 90-day placement and refund conditions;
  5. the Client understands that a ₹5,000 operational deduction may apply after Service Commencement where a refund is otherwise payable;
  6. the Client understands the Replacement Policy and prevailing-market salary condition;
  7. the Client agrees to provide safe, respectful and lawful working conditions;
  8. the Client agrees not to compel Domestic Workers to undertake unauthorised duties;
  9. the Client agrees to promptly report material incidents to Kaamvali; and
  10. the Client agrees to be bound by these Terms.
